Overview – Website terms of use

This page, along with our Cookie and Privacy Policy, sets out details about us and the terms and conditions (the “Terms”) that apply when you buy products from our website. These Terms form part of the contract between you and us for the sale of any products (the “Contract”). Please read them carefully before placing an order. By purchasing from our site, you agree to accept these Terms.

2. Our Products

2.1 Products listed on our website depend on stock availability. If something you’ve ordered is out of stock, we’ll let you know by email and won’t charge you for it.

2.2 Confidence Guarantee
If a supplement you’ve bought from the-herbtender.com isn’t right for you, get in touch within 30 days of receiving your order. We’ll look into it and offer a refund if appropriate. Email us at hello@the-herbtender.com to start the process.

3. How we use your information

We handle your personal data in line with our Cookies and Privacy Policy. Please read these carefully, as they include terms that apply to you.

4. If you’re shopping as a consumer

(This section applies to individual customers only.)

4.1 You must be 18 or over to place an order on our site.

4.2 These Terms, along with our Cookies and Privacy Policy, set the terms of the agreement between you and us.

4.3 You’re protected by consumer law if a product is faulty or doesn’t match its description. For advice, contact your local Citizens Advice or Trading Standards. These Terms don’t affect your legal rights.

5. For trade customers

If you're buying on behalf of a business, please refer to our separate trade terms and conditions, available here.

6. How your contract with us is formed

6.1 Our ordering system lets you review and correct any mistakes before you submit your order. Please check your details carefully at each step.

6.2 Once you place an order, we’ll send you an email confirming we’ve received it. This doesn’t mean your order is accepted yet.

6.3 Your order is accepted, and the contract formed, only when we send you an email confirming the order and its dispatch details.

6.4 If we can’t supply a product—due to stock issues, unavailability, or pricing errors—we’ll notify you by email and won’t proceed with your order. If you’ve already paid, we’ll refund the full amount promptly.

7. Changes to these Terms

7.1 We may update these Terms occasionally, especially when:

(a) payment methods change; or

(b) laws or regulations are updated.

7.2 The Terms in place at the time you make an order will apply to that purchase.

7.3 When we update these Terms, we’ll let you know by noting the changes and the date at the top of this page.

8. Cancellation and refund rights for consumers

(This section applies only if you’re buying as a consumer. For subscription cancellations, see clause 8.11.)

8.1 As a consumer, you have the legal right to cancel your order under the Consumer Contracts Regulations 2013 during the period detailed in 8.3. If you change your mind or decide you no longer want a product, you can tell us and get a refund. For advice, contact Citizens Advice or Trading Standards.

8.2 This cancellation right doesn’t apply if the product’s tamper-evident seal has been broken.

8.3 You can cancel from the date you receive the Dispatch Confirmation, which marks the start of the contract. If the product has already arrived, you have 14 working days from the day you receive it to cancel.

8.4 To cancel, please email us at hello@the-herbtende.com. It’s a good idea to keep a copy of your cancellation notice.

8.5 We’ll refund the full price paid as soon as possible, and within 30 calendar days from when we get your cancellation notice. For faulty or wrongly described items, see 8.6.

8.6 If you return a faulty or mis-described product, we’ll refund the product cost, delivery charges, and reasonable return shipping costs.

8.7 Refunds will be made to the card you used to pay.

8.8 If products have been delivered:

(a) Please return them promptly.

(b) Unless faulty or mis-described, you cover return postage costs.

(c) You must take reasonable care of the items while they’re with you.

8.9 Consumer rights for faulty or mis-described products remain unaffected by this policy or these Terms. For guidance, contact Citizens Advice or Trading Standards.

8.10 For subscription changes, log into you’re The Herbtender account to modify, pause, or cancel orders anytime. Subscriptions ship every 28 days, so you must cancel or edit before 2 pm GMT (Monday to Friday) two days before dispatch. Once an order is processed, we can’t cancel or refund it.

9. Delivery

9.1 We aim to dispatch your order within 1-4 business days, unless unexpected events beyond our control occur. If this happens, we’ll update you with a new estimated delivery date.

9.2 Delivery is complete once the products arrive at the address you provided. For all UK orders, you can expect your order to arrive in 1-4 business days. Please note that we do not fulfil orders on weekends, so if you order on a Saturday or Sunday, your order will be sent out the following Monday. We use a mix of Evri, DPD, and Royal Mail to ensure timely deliveries across the UK.

9.5 Responsibility for the products passes to you once delivery is complete.

9.6 Ownership of the products transfers to you after we receive full payment, including any delivery fees.

10. Product Prices and Delivery Charges

10.1 Product prices are listed on our site and updated regularly. We aim to keep all pricing accurate, but if there’s a mistake with the price of something you’ve ordered, see point 11.5 below for how we handle it.

10.2 Prices may change over time, but any confirmed orders won’t be affected.

10.3 VAT is included where applicable, based on the current UK rate. If the VAT rate changes after you’ve placed an order but before dispatch, we’ll adjust the total unless you've already paid in full.

10.4 Delivery costs aren’t included in product prices. You can view current delivery charges on our Shipping Policy page.

10.5 Occasionally, pricing errors happen despite our checks:

(a) If the correct price is lower than listed, we’ll charge you the lower price—unless it’s clearly an obvious mistake, in which case we’re not obliged to honour it.

(b) If the correct price is higher, we’ll email you to confirm whether you'd like to proceed or cancel. If we don’t hear back, we’ll cancel the order and let you know.

11. Payment

11.1 We accept payment by debit card, credit card, PayPal, and Clearpay.

11.2 You’ll be charged in full for your order, including delivery, when you place it.

12. Product Warranty and Disclaimer

12.1 We guarantee that your order will match the product details confirmed at dispatch and be free from major defects when it arrives. This guarantee doesn’t apply in the cases listed below.

12.2 This warranty doesn’t cover faults caused by misuse, poor storage, accidents, negligence (yours or someone else’s), or failure to follow usage instructions.

12.3 We aim to keep the site content accurate and current, but we can’t guarantee it. We’re not responsible for errors, outdated info, or content on third-party sites linked here. Views shared by others don’t always reflect our own.

12.4 The information on this site is for general use only. It’s not medical advice. If you’re unsure about using a supplement, speak to your medical professional first. Supplements should support a balanced diet and healthy lifestyle, not replace them.

12.5 Our products are sold as food supplements. They’re not designed or sold for treating any specific health condition.

12.6 Unless stated otherwise, all Herbtender products are made, labelled and sold in line with current UK food and food supplement laws.

12.7 Best Before dates are based on the product being stored as instructed, in typical UK conditions. Heat, humidity or storage outside the UK may affect product quality. We’re not responsible for damage caused by poor storage or extreme environments.

13. Our liability to trade customers

14. Our liability to consumers

(This section applies if you're buying as a consumer.)

14.1 If we don’t follow these Terms properly, we’re liable for any loss or damage that could reasonably be expected as a result of that. We’re not liable for anything unexpected. A loss is considered foreseeable if it was clear it might happen, or if you and we discussed it when the order was placed.

14.2 Our products are sold for personal use at home. You agree not to use them for business, resale, or commercial purposes. We’re not liable for any loss of profit, business, or related interruption.

14.3 We don’t limit or exclude our liability for:

  • death or injury caused by our negligence
  • fraud or deliberate misrepresentation
  • ownership rights under section 12 of the Sale of Goods Act 1979
  • rights relating to product description, quality, or suitability under sections 13–15 of the Sale of Goods Act 1979
  • defective items covered by the Consumer Protection Act 1987

15. Things beyond our control

15.1 We’re not responsible for delays or failure to meet our obligations if events happens that we couldn’t reasonably prevent or predict.

15.2 This includes things like strikes, industrial action, civil unrest, war or threats of war, terrorism, natural disasters (such as floods or earthquakes), fires, pandemics, transport issues, or problems with power or telecoms that are outside our control.

15.3 If any of these events affect our ability to deliver on our contract with you:

(a) We’ll let you know as soon as we can

(b) Our responsibilities will be paused while the issue continues. If your delivery is affected, we’ll arrange a new date once the situation is resolved.

16. How we communicate

16.1 When we mention “in writing” in these Terms, that includes emails.

16.2 If you need to contact us in writing—or if these Terms require written notice—you can email us or write to: The Herbtender Ltd, 13 Hope Street Yard, Hope Street, Cambridge, CB1 3NA. We’ll confirm we’ve received it, usually by email. If you’re cancelling under clause 8, please follow the instructions in that section.

16.3 If we need to contact you, we’ll do so by email or by post using the details you gave when placing your order.

If something happens beyond our control:

(a) We’ll let you know as soon as we can

(b) Any agreed timelines will be paused, and we’ll set new ones once things are back on track—this includes arranging a new delivery date if needed.

17. Other key terms

17.1 We may pass on our responsibilities and rights under this contract to another company. If we do, your rights won’t be affected. We’ll let you know either in writing or by updating this page.

17.2 You can only transfer your rights or obligations under these Terms to someone else if we agree in writing.

17.3 This agreement is just between you and us. No one else has the right to enforce any part of it under the Contracts (Rights of Third Parties) Act 1999 or any other law.

17.4 Each part of these Terms stands on its own. If any part is found to be illegal or unenforceable, the rest still apply.

17.5 If we don’t immediately act on something you’ve not done under these Terms, it doesn’t mean we’ve given up our rights. And if we do waive something, it will be in writing and won’t apply to any future issues.

17.6 If you're a consumer, these Terms are under English law. Any dispute will be handled by the courts of England and Wales, though you may also have rights to bring a claim elsewhere if you live outside England.

Promotions

We’ll occasionally run special offers on the Website, each with its own terms and conditions. These may be time-sensitive, so your order must be fully completed within the specified timeframe to qualify.

If an offer includes a free item or discount (like buy one, get one free), it will only apply to products clearly marked with the promotional message on their product pages. Unless stated otherwise, the offer will apply to the lowest-priced eligible item.

Promotions can’t usually be combined with other discounts, offers, or voucher codes unless we’ve said so. We may change or end any promotion at any time without prior notice.

Summer Sale 2025 Terms and Conditions

The Herbtender Summer Sale runs from 25 July 2025 at 06:00 BST until 08 August 2025 at 23:59 BST. The promotion is open to all customers who make a purchase on www.the-herbtender.com during this period. You’ll receive 30% off all individual supplement products with the code SummerSale and 10% off all individual organic herbal teas with the code SummerTea. Sets and accessories are excluded from the promotion. These discounts apply to one-time purchases and subscription orders. Supplement subscriptions will receive 44% off the first month (based on RRP), then revert to the standard 20% off from month two. Organic herbal tea subscriptions will receive 28% off the first month (based on RRP), followed by 20% off from month two. Discounts do not apply to gift cards or past purchases and cannot be used with any other offer unless stated. The discount is automatically applied to eligible products at checkout—no code needed. The offer is limited to one use per customer. It can’t be transferred, refunded or exchanged for cash or other products. Shipping fees and taxes are not discounted unless explicitly stated; you’ll be responsible for any applicable charges. Our standard returns policy applies, and refunds will be for the price paid after the discount. The Herbtender may change or end the promotion at any time without notice.
